This Elopement Photoshoot Agreement (“Agreement”) is entered into and effective as of the date and time of the Client’s submission of the booking form, which shall serve as the official record of the commencement of this Agreement, between:

(“Photographer”)
and
Client: The individual engaging photography services, as identified in the corresponding booking form and/or e-signature record
(“Client”)
Photographer agrees to provide photography services as selected and confirmed by the Client through the official booking form. The booking form, including any selected session type, packages, or add-ons, is incorporated into this Agreement by reference and constitutes the agreed-upon services.
The specific scheduling details for the session, including the date, time, and location, will be mutually agreed upon and confirmed between the Photographer and Client via electronic communications, including but not limited to email, SMS, phone, or direct messaging.
a. Price: The total session fee shall be the agreed-upon price as selected by the Client in the booking form, including any applicable add-ons or upgrades.
b. Retainer (Deposit): A non-refundable retainer of fifty percent (50%) of the agreed-upon price is required to reserve the Photographer’s time and secure the session date. This retainer is applied toward the total balance and compensates the Photographer for reserving the time, planning, and preparation. The retainer is non-refundable under all circumstances, including cancellation or rescheduling by the Client, except as provided in Section 4(a).
c. Final Payment: The remaining balance is due no later than forty-eight (48) hours prior to the scheduled session. This balance may be automatically charged to the payment method provided at booking. If the charge fails, the Client is responsible for completing payment promptly via invoice.
d. Late Payments: Failure to submit final payment on time constitutes a breach of this Agreement and may result in cancellation of services without refund of the retainer.
e. Optional Rush Delivery Upgrade: The Client may elect to purchase a rush editing upgrade for an additional fee of Fifty Dollars ($50.00), as indicated in the booking form. If selected, Photographer agrees to deliver the edited images within seventy-two (72) hours after the conclusion of the session.
If the Photographer fails to deliver within this timeframe, the Client’s sole remedy shall be a full refund of the rush delivery fee. The rush fee is otherwise non-refundable, regardless of whether the session takes place.
This turnaround time is contingent upon timely cooperation from the Client, including but not limited to prompt image selection (if applicable) and full payment of any outstanding balance. If any balance remains unpaid at the conclusion of the session, the seventy-two (72) hour delivery period shall begin only once full payment has been received.
Delays caused by factors outside the Photographer’s control, including but not limited to technical failures, acts of God, or unforeseen circumstances, may extend delivery time without obligation to refund the rush fee.
A. Late Arrival & No-Show: The Client is granted a ten (10) minute grace period from the scheduled start time. If the Client fails to arrive within this period, the Photographer reserves the right to terminate the session without refund.
B. Session Duration: If the Photographer proceeds with a late-start session, it will still conclude at the originally scheduled end time.
C. Requested Extensions & Billing: Any extension beyond the scheduled session is subject to Photographer approval and billed at $75.00 per fifteen (15) minute increment, rounded up.
D. Payment & Delivery: Extension fees must be paid within two (2) calendar days of invoicing. Image delivery will not occur until all outstanding balances are paid in full.
a. Photographer Cancellation: If the Photographer cancels for any reason (excluding Client breach or no-show), the Client will receive a full refund of all amounts paid, including the retainer and Rush Fee, if applicable.
b. Client Cancellation & Rescheduling: Retainers are non-refundable. If the Client cancels or reschedules more than 48 hours before the session, the retainer may be applied as a credit toward a future session within six (6) months, subject to availability and updated pricing. Cancellations within 48 hours result in forfeiture of the retainer and rush fee if applicable.
c. Weather: Photographer retains sole discretion to reschedule due to unsafe or unsuitable weather conditions. If canceled by Photographer due to weather, all payments (including retainer and rush fees) will be refunded.
a. Photographer retains full creative control over the session and editing process. Specific results are not guaranteed.
b. Final images will be delivered via an online gallery, available for at least thirty (30) days from the date of delivery.
c. The number of delivered images is determined at Photographer’s discretion based on quality standards.
d. Client receives a non-exclusive, non-transferable license for personal use only.
a. Client agrees to credit “Valentina Duarte Photo” when sharing images publicly.
b. Client shall not edit, crop, apply filters, or otherwise alter images without written consent from the Photographer.
c. Liquidated Damages for Unauthorized Alterations: Unauthorized alterations are subject to liquidated damages equal to ten (10) times the agreed-upon session price.
d. Photographer retains the right to use images for portfolio, marketing, and promotional purposes without the need to seek further permission from any persons who participated in the photoshoot.
a. Photographer is not liable for injury, loss, or damage except in cases of gross negligence or willful misconduct.
b. Client agrees to indemnify Photographer against claims arising from circumstances beyond Photographer’s control.
c. Photographer is not responsible for delays or failures due to events such as weather, accidents, or other unforeseen conditions.
The Client agrees to:
Arrive at least 15 minutes early to the scheduled session.
Act respectfully during the session; disruptive conduct may result in immediate termination without refund.
Ensure timely payment of all fees.
Bring all desired props, outfits, or accessories.
Communicate any delays or changes promptly.
Failure to comply may result in termination of services without refund.
This Agreement shall be governed by the laws of the State of Texas. Any disputes shall be resolved in Bexar County, Texas.
This Agreement, together with the booking form, constitutes the entire agreement between the parties. Any modifications must be in writing and signed by both parties. Electronic signatures, including the act of submitting the booking form, are legally binding and enforceable.
